Terms and Conditions

Welcome to Femi.Eko! These Terms and Conditions ("Terms") govern your use of the www.femieko.com website ("Site") and your purchase of Femi.Eko products ("Products") through this Site. By accessing or using our Site and/or purchasing Products, you agree to be bound by these Terms, including any additional terms, conditions, and policies referenced herein or available by hyperlink. 

We are committed to providing a safe, enjoyable, and seamless shopping experience.

1. Definitions

• “Shopping Cart”: A feature on the Site that allows the Buyer to select and order Products.
• “Buyer”: A consumer (an individual) who intends to order Products from the Site and enter into a contract with the Seller.
• “Shop”: The online platform available at www.femieko.com where the Seller presents and offers Products for sale.
• “Terms”: These General Terms and Conditions governing the use of the Shop and the sale of Products.
• “Seller”: FEMIEKO ApS, CVR DK43804391, with a registered office at Bjerget 24, Varde, 6800, Denmark, the owner of the Femi.Eko brand.
• “Contract”: A legally binding agreement between the Buyer and the Seller formed when the Buyer places an order via the Shop and the Seller confirms the order.
• “Goods”: The physical products offered for sale by the Seller through the Shop.
• “Complaint”: A Buyer’s report of defects in the Goods in accordance with Article 9 of these Terms and Conditions.

2. General Information

• These Terms are written in English. Contracts may be concluded in English, according to the Buyer's preference.
• The Seller reserves the right to amend these Terms at any time. Any changes will take effect immediately upon publication on the Site and will not affect orders placed before the change.
• The Seller is a VAT-registered business. All prices listed on the Site include VAT and OSS policy will apply to foreign Buyers. 
• The Buyer is responsible for ensuring all information provided during the purchase process is accurate and complete.
• The Seller reserves the right to refuse service, cancel orders, or limit the quantities sold to any person or entity at its sole discretion.

3. Placing Orders

3.1 Order Process

• The Buyer selects Goods and adds them to the Shopping Cart. At checkout, the Buyer must provide the necessary information to complete the order, including payment and delivery details. By clicking the “Pay” button, the Buyer confirms the order and enters into this Contract with the Seller.

3.2 Order Confirmation

• After receiving the order, the Seller will send an order confirmation to the email address provided by the Buyer. This confirmation will include details of the Goods ordered, the total price, and delivery information. The Contract is deemed concluded when the Seller sends this confirmation.

3.3 Pre-orders

• For pre-orders, payment is reserved at the time of ordering, but funds will not be collected until the Goods are ready for dispatch. An estimated delivery date will be provided for pre-ordered items, and the Seller will keep the Buyer informed of any changes or updates.

3.4 Pricing and Availability

• All prices are listed in Euro (EUR) and include VAT unless stated otherwise. Prices and availability of Goods are subject to change without prior notice. The Seller reserves the right to correct any pricing errors that may occur.
• Discounts cannot be used when purchasing gift cards. If a discount is given for purchasing a minimum quantity of items and some items are returned, resulting in a total purchase value below the minimum for the discount, the discount will be deducted from the refund.
• Shipping costs are additional to the price of the Products and vary according to the delivery area.
• The Buyer is responsible for any customs duties required by law in the delivery area. We apply the OSS rule for intra-community deliveries.

3.5 Payment Methods

• The Seller accepts various payment methods, including Visa, Mastercard, MobilePay, Google Pay, and Apple Pay. Payment is processed securely via PensoPay. The Buyer will only be charged once the order has been confirmed and the Goods are ready for dispatch.
• The Seller reserves the right to refuse service to anyone for any reason at any time, and we do not sell to certain countries, such as Russia.
• The Buyer understands that their content (excluding credit card information) may be transferred unencrypted and may involve (a) transmissions over various networks; and (b) modifications to conform to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
• The Seller is not responsible for any commissions the Buyer's bank applies while the online payment is made.

4. Delivery and Shipment

4.1 Shipping Methods

• The Seller offers delivery via GLS within Denmark and UPS for international orders. The Buyer can choose their preferred delivery method during checkout.

4.2 Delivery Times

• The estimated delivery time is 1-3 business days within Denmark and 2-4 business days for international shipments, depending on the destination. Delivery times are estimates and are not guaranteed.

4.3 Shipping Costs

• Shipping costs are calculated at checkout based on the delivery method and destination:
• Free shipping may be offered during promotional periods as indicated on the Site.
• International deliveries via UPS or DHL are subject to varying costs based on territory and delivery status.

4.4 Risk of Loss

• The risk of loss, damage, or destruction of the Goods passes to the Buyer upon receipt of the Goods. During transport, the Seller is responsible for any loss, damage, or destruction and is obliged to replace the products in such cases.

4.5 Tracking

• Once the order has been shipped, the Buyer will receive a tracking number via email to monitor the delivery status.

5. Exchange and Return Policy

At Femi.Eko, your satisfaction is our top priority. We are committed to ensuring that you love every product you purchase from us. If for any reason you're not completely happy, we provide easy and flexible return and exchange options to make sure you have the best possible experience with Femi.Eko.

5.1.1 14-Day Return Policy

• Eligibility: You have the right to return your products within 14 days of receiving your order, unless otherwise agreed or specified in your order.

• Conditions:
• The products must be returned in their original condition, unused, unwashed and with all original packaging and labels.
• The return must be made within 14 days of receipt of the products.
• The cost of the return is to be borne by the customer, unless the return is due to a defect or error on our part.

5.1.2 Return Process

You have two options for returning your products:

1. Using Our Return Label:
• Purchase a return label through our return portal - HERE. You will receive a return label that is insured by us and handled by UPS- at a cost of 10 EUR, which will be deduced from the refund.
• Print and attach the return label clearly to your return package.
• Pack all items securely in the original packaging, if possible.
• Drop off the package at your nearest UPS parcel shop or pick it up at your address by a carrier.
2. Using Your Own Return Label:
• Purchase a return label through an external provider directed to our business address. Please note that returns to parcel shops (e.g., DAO & Postnord) are not accepted.
• Clearly attach the return label to your return package and include a note with your name, order number, and reason for return.
• Pack all items securely in the original packaging, if possible.

5.1.3 Exchange Policy

• We offer free exchanges for different sizes. To exchange your item for a different size, please follow the steps below:
• Visit our exchange portal - HERE and follow the instructions to select a new size.
• Pack the item securely in its original packaging, if possible, and use the provided return label to send it back to us.
• Drop off your package at the nearest UPS parcel shop or pick it up at your address by a carrier.

5.1.4 Processing Time

• Returns: Once we receive your return package, the return process may take up to 14 business days. Refunds will be issued to the same payment method used for the original purchase. Please note that it may take 2-5 business days for the refund to appear in your account, depending on your bank.
• Exchanges: The exchange process may take up to 7 business days once we receive your package.

Important: Please fill out and include the return slip when returning a package to us. Failure to include this slip may delay the return process.

5.1.5 Return and exchange Terms

• You have 14 days to return or exchange a product from the day you receive your package. This means that the item must be sent back no later than 14 days after you have received your package.
• Returns or exchanges received after this period will not be accepted.
• It is your responsibility to check whether your return period has expired before sending the package back to us. We cannot refund the cost of the return label if the return period is exceeded.

5.1.6 Returning Gifts

• If you have received a gift purchased from us and wish to return it, the standard return policy applies unless an extended return period has been agreed upon. The refund can only be processed to the original payment method used for the purchase. You can also exchange the item for a different size or product or request a store credit, if preferred.

5.2 Satisfaction Guarantee

At Femi.Eko, your satisfaction is our top priority. We want you to have the best experience with our products, and we understand that finding the perfect match can sometimes take time. 

Terms of the Satisfaction Guarantee:

• 90-Day Exchange Period: This guarantee applies to first-time customers and allows for the exchange of one product within 90 days of the purchase date.
• One Product per First Order: The satisfaction guarantee covers the exchange of one product per initial order.
• Product Condition: The product must be unused, unopened, and returned in its original packaging with all labels intact. We do not accept used products for exchanges or returns.
• Return Process: To initiate an exchange, please contact us by emailing hello@femieko.com. Include your name, address, email, order number, the item you wish to exchange, and the reason for the exchange.
• Shipping Costs: The cost of return shipping and delivery of the new product is the customer's responsibility. We will provide you with the necessary return shipping labels via email.
• Exchange Procedure: Customers can exchange the product for another item of equal value or choose a different product and pay the price difference via a secure payment link sent by email.
• No Refunds: This guarantee does not offer refunds. To be eligible for a “money-back” refund,  you must apply directly to our return portal within 14 days of purchase.

Exclusions from the Satisfaction Guarantee:

• Products marked as “final sale,” “limited edition,” or purchased with special discounts or promotional offers (such as coupons or giveaways) are not eligible for return or exchange under this satisfaction guarantee.
• Only menstrual cups, menstrual discs, period panties, and reusable pads are covered under the satisfaction guarantee. Accessories and other non-specified products are not eligible for exchange rights.

Third-Party exclusions

• If you have purchased Femi.Eko products from a third-party retailer or distributor, please contact the store or distributor directly for their specific return and exchange policies. Our Satisfaction Guarantee and return policy apply exclusively to purchases made directly through our official website. We encourage you to reach out to the original place of purchase, as they may have their own dedicated return or exchange policy to assist you with your request.

6. Promotions and Discounts

6.1 Free Gift with Purchase

• Femi.Eko occasionally offers free gifts with qualifying purchases. One free item is offered per order, and the minimum purchase amount (e.g., 89 EUR) must be met to qualify. The free item cannot be returned for a refund, exchange, or store credit. The free item cannot be customized or altered.

6.2 First Order Discount

• New customers can enjoy a 10% discount on their first order by subscribing to the Femi.Eko newsletter. This offer excludes bundle packs, sale items, gift cards, and other promotions. The discount is only valid on the regional website where the Buyer signed up.

6.3 Voucher and Coupon Usage

• Vouchers and coupons issued by Femi.Eko are subject to specific terms and conditions. Vouchers are valid for a specified period and may be applied to eligible products as described in the promotional offer. Only one voucher can be used per order, and vouchers cannot be combined with other discounts or promotions.

7. Right of Withdrawal

7.1 Withdrawal Period

• The Buyer has the right to withdraw from the Contract within 14 days of receiving the Goods, except in cases specified under Article 7.2. To exercise this right, the Buyer must notify the Seller via email at hello@femieko.com within this period.

7.2 Exceptions to Withdrawal

• The right of withdrawal does not apply to:
• Sealed Goods that have been opened after delivery and are not suitable for return due to hygiene reasons (e.g., menstrual cups, menstrual discs, period underwear for which the hygiene label was removed, or products that have been washed, boxes that have been destroyed, or unsealed if such a case is applicable).
• Goods that have been marked as last items, or have been part of a special offer or promotion, and marked as such when purchased.

7.3 Return Process

• If the Buyer exercises the right of withdrawal, they must return the Goods to the Seller at their own expense within 14 days of notifying the Seller. The Goods must be returned in their original condition, unused, and with all original packaging intact.

7.4 Refunds

• Refunds will be processed within 14 days of the Seller receiving the returned Goods. Refunds will be issued using the same payment method used for the original transaction. The Seller reserves the right to reduce the refund amount if the Goods are returned in a condition that diminishes their value.

8. Warranty and Complaints

8.1 Warranty

• The Seller provides a 2-year warranty on all Goods in accordance with the Danish Sale of Goods Act. This warranty covers defects in materials and workmanship.

8.2 Complaint Process

• If the Buyer discovers a defect in the Goods, they must notify the Seller within a reasonable time. The Seller considers up to 90 days as a reasonable time unless otherwise agreed. Complaints should be submitted via email to hello@femieko.com, including a detailed description of the defect and proof of purchase.

8.3 Resolution of Complaints

• If the complaint is justified, the Seller will offer to replace the defective Goods. If repair or replacement is not possible, the Buyer may request a refund or a reasonable price reduction. The Seller will cover reasonable shipping costs for returning defective Goods.

9. Use of the Website

9.1 Website Modifications

• The Seller reserves the right to modify the website, its content, and its functionality at any time without prior notice. The Seller may also temporarily suspend access to the website for maintenance or other reasons.

9.2 User Responsibilities

• The Buyer agrees to use the website in compliance with all applicable laws and regulations. The Buyer is responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.

9.3 Intellectual Property

• All content on the website, including text, images, and software, is the property of the Seller or its licensors and is protected by copyright and other intellectual property laws. The Buyer may not reproduce, distribute, or otherwise exploit any content from the website without the Seller’s prior written consent.

10. Privacy Policy

10.1 Data Collection

• The Seller collects personal data necessary for processing orders, including the Buyer’s name, address, email, and payment information. This data is stored securely and processed in accordance with the Danish Data Protection Act and the General Data Protection Regulation (GDPR).

10.2 Use of Personal Data

• The Seller uses personal data solely for the purpose of fulfilling orders and providing customer service. The Seller does not sell or share personal data with third parties without the Buyer’s consent, except as required by law.

10.3 Cookies

• The website uses cookies to enhance the user experience, analyze traffic, and for marketing purposes. The Buyer can manage or disable cookies through their web browser settings.

10.4 Data Subject Rights

• The Buyer has the right to access, correct, or delete their personal data held by the Seller. To exercise these rights, the Buyer should contact hello@femieko.com.

11. Consumer Protection

11.1 Applicable Law

• These Terms and Conditions are governed by Danish law. The Buyer is protected under the Danish Consumer Protection Act and other relevant regulations, including those applicable to online transactions.

11.2 Dispute Resolution

• In the event of a dispute, the Buyer may contact the Danish Consumer Complaints Board (Forbrugerklagenævnet) or use the EU’s Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr.

12. Final Provisions

12.1 Severability

• If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

12.2 Assignment

• The Seller reserves the right to assign its rights and obligations under these Terms and Conditions to a third party.

12.3 Changes to Terms

• The Seller may update or change these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the website. Continued use of the website constitutes acceptance of the new terms.
